Passing without a will in place could leave your loved ones facing financial hardship, unbearable pressure and mounting legal fees at a time of mourning A will makes it clear what should happen with your assets and can therefore significantly reduce the worry and anxiety that your family will suffer. Without a will what is likely to happen? Few people consider what could happen in the months and years that follow. Assets may be taken away by the state or frozen in lieu of court judgements, and also, if a surviving partner remarries, then it is very possible that your children don’t get the inheritance that you would have liked them to have. The majority of people believe that the spouse or partner will inherit the estate automatically when the deceased did not have a will in place. However, the inheritance process is not always very satisfactory. A deceased person’s estate is often the source of a lot of fighting and resentment when it comes to families distributing assets and wealth.

The arguments and disagreements that follow can be heart-breaking at such a difficult time. You may not like how the law distributes your estate if you don’t have a will in place. As someone married with children, you would expect your spouse to inherit everything, but this is not necessarily automatically the case. Your spouse may benefit, but assets may also be distributed amongst your children. The law won’t necessarily recognise your partner an inheritor if you are not married. Having a will in Normandy is crucial to protect against anything you don’t want happening to your estate.

How will your will be stored? The way in which your will is stored and is readily accessible could make the difference between you having a legally binding and accessible will, or dying “intestate”, due to your will not being found or usable at the time of your estate’s distribution. Your executors need your will to be undamaged, and within easy access when the time comes, so you need to store it safely and somewhere where other people won’t be able to access it before the required time. The people that you want to inherit your money and possessions might not be able to do so if your will is damaged or if it can’t be found by your executors after you have died. It might be a good idea to store your will with the probate service, a separate solicitor or with our own storage service for wills – we can advise you on the best option.
The Society was formed all the way back in 1994 and has gone on to be the leading and the largest body regulating will writers and estate planners. The Society is a self-regulatory body that vets potential members through stringent criteria and standards of proficiency and provides ongoing training.
Established in 1991 as a self-regulatory body, The Institute of Professional Will Writers protects the general public from practitioners who are unethical, unqualified and not fit to work in the will writing industry, and has become the recognised body for promoting and regulating the profession.
