If you were to pass without a will it could cause financial difficulties, the responsibility for legal fees and many other pressures that fall to your loved ones at the time of mourning. A will helps protect your assets and relieves the debilitating worry your family could face. If I don’t draw up a will what can happen? It’s not easy to think about the future and what could happen without a will. Property, cash, investments and other assets may be frozen or the state may claim some or a portion of them, and if a partner remarries then your children may not get the inheritance that you want them to have. It is a commonly held belief that the spouse or partner is the automatic inheritor of an estate when the deceased has no will. However, the way this happens does not suit everyone. There are often disputes over an estate between relatives.

It is always important to have a plan in place at every stage of life, whether you are buying a new property, trying to understand how are your estate would be split, or are just simply trying to have a bit of control for the future. Our will-writing professionals in Meads ensure that your exact requirements are met in the will that they produce.
The arguments and disagreements that follow can be heart-breaking at such a difficult time. When there is no will in place, your assets will be distributed according to the law, which may not be in line with what you want. As someone married with children, you would expect your spouse to inherit everything, but this is not necessarily automatically the case. Instead, your assets may be divided between your spouse and your children. If you aren’t married, then your partner may not be an automatic beneficiary in the eyes of the law. A will can protect your estate from almost any eventuality.
Will writing doesn’t have to be an expensive, stuffy experience you put off until it’s too late!
As well as offering high-quality will writing, Brighton Wills and Family Trust is happy to provide a full selection of estate planning services. Whether you need family trusts or probate forms, or want to prepay a funeral to take the strain off your family in the future, we can help.
We can make the required provisions for the legality of Lasting Powers of Attorney (LPA). If you have diminished mental capacity due to an illness, or because you have an accident, you may need a trusted person to have LPA and it will make it a lot easier if this is organised prior to the life changing event occurring.
How will your will be stored? It is crucial that your will is stored safely and is readily accessible so that you don’t die officially “intestate”, where no valid will was found to be used following your passing. Once you have your will, you need it stored safely where people can’t randomly access it, but where your executors will be able to find it in order to execute your decisions. If your will is damaged or if your executors can’t find it after your death, then your wishes might not be followed and the people that you want to inherit your possessions and money might not do so. It might be a good idea to store your will with the probate service, a separate solicitor or with our own storage service for wills – we can advise you on the best option.
The Society was formed all the way back in 1994 and has gone on to be the leading and the largest body regulating will writers and estate planners. The Society of Will Writers act as a self-regulatory body by vetting practitioners through stringent membership requirements, proficiency standards and ongoing training.
The Institute of Professional Will Writers (IPW) was founded in 1991 as a self-regulatory body to safeguard the public from unqualified practitioners and unethical business practices and has become established as a recognised professional regulating body which promotes the profession of will waiting in the United Kingdom.
